NEPA Policy and Case Law Update

The National Environmental Policy Act (NEPA) celebrated its 50th birthday in 2020. After a relatively quiet period of several decades with few changes to the statute and its implementing regulations, the past several years have seen a tremendous amount of change on the policy-making and regulatory front. Meanwhile, NEPA litigation remains alive and well as federal court decisions continue to interpret key provisions of the impact assessment requirements under NEPA.

This webinar will cover a variety of topics, including the background of and detailed changes to the NEPA process resulting from recent changes to the NEPA Implementing Regulations; changes related to environmental policy generally and NEPA specifically; new policy goals incorporating climate change and environmental justice into the NEPA process; and key lessons from recent key NEPA federal court decisions, and how best to apply them to current and future NEPA analyses.

The webinar is designed for mid- to senior-level NEPA practitioners who need to be informed of these updates and rulings.
